Contract

Camtrack Devices/Units are subject to a monthly subscription paid in advance.

Devices/Units will be charged on the first day of each calender month and are subject to a rolling one month contract.

Cancellation of any subscription must be made via email and must be acknowledged by reply email from Camtrack.

A period of one full calender month is required to cancel or put on hold any Camtrack Device/Unit subscription.

The one month notice period shall start on the last day of the calender month that the cancellation was requested and acknowledgement was made by reply email regardless of the date of that month that the email was sent and acknowledged.

Any Device/Unit that is rectivated and/or reports into the servers at any point during a calender month shall be charged retrospectively for that month period in full.

Should a Camtrack Device/Unit that has been cancelled for more than three calender months require reactivation, this may require a replacement SIM card and installation, whilst a SIM card hardware will be provided free of charge any labour costs associated with this replacement is the liability of the end user of the Camtrack Device/Unit

Camera Systems and Memory Related to Camera Systems

It is the End users responsibility to regularly check that camera systems are functioning and operating correctly, camera systems that have means of recording footage require regular maintenance and inspection which is the liability of the end user.

Memory that is fitted within camera systems may require replacement or become corrupt and/or damaged over a period of time due to the nature of the record and over write operation of the camera system.

Camtrack Recommend that Memory within a camera system is checked regularly for correct operation and is replaced on an annual basis. Any costs assosciated with replacement or maintenence of Memory is the responsibility of the end user.

Camtrack will not be held liable for any footage loss as a result of faulty memory within a camera system and or defective or failing equipment

Camtrack will not be held liable for any third party intervention to any equipment.

Immobilisation

Text immobilisation and system immobilisation uses sim card SMS and or GPRS data, this functionality must only be used when a device is within a good signal area and the vehicle is stationary with the ignition off, failure to do so may result in a device being left in an immobilised state if there is no network coverage available to receive a command from the system or a text message to mobilise, Camtrack will not be held responsible nor liable for any costs incurred directly or indirectly for stranded assets due to supplied Camtrack Product(s) component failure in any part or due to commands being sent to units in position where the device cannot accept the command due to poor network coverage including but not limited to underground carparks, known blackspots or as a result of insufficient network connection to the Camtrack Product(s) unit.

Clause 1

The Camtrack will not be held responsible nor liable for any costs incurred directly or indirectly as a result of either Product(s) failure or non communication to the Camtrack Product(s) as a result of systems, technologies and other factors which are beyond Camtracks control including but not limited to: smartphone incompatibility, mobile communication networks, Global Positioning System technologies (GPS) and General Packet Radio Service technologies (GPRS) or 3rd Generation Mobile Phone technologies, Short Messaging Service (SMS) operated by third part providers, the Internet, telephony and interconnected systems; Due to the nature of such technologies, systems and other factors, problems including but not limited to, outages, link failures, power difficulties, network overloads, signal degradation and topographic, electromagnetic and other interferences and government intervention may have an adverse effect on the availability of the Website and Service(s).

Clause 2

The end user acknowledges and agrees that The functionality of the Camtrack Product(s) Platform and the availability of the website (or relevant parts thereof) and the service(s); is dependent upon systems, technologies and other factors which are beyond Camtracks control including but not limited to: smartphone incompatibility, mobile communication networks, Global Positioning System technologies (GPS) and General Packet Radio Service technologies (GPRS) or 3rd Generation Mobile Phone technologies, Short Messaging Service (SMS) operated by third part providers, the Internet, telephony and interconnected systems; Due to the nature of such technologies, systems and other factors, problems including but not limited to, outages, link failures, power difficulties, network overloads, signal degradation and topographic, electromagnetic and other interferences and government intervention may have an adverse effect on the availability of the Website and Service(s).

Clause3

While the The Supplier endeavours to ensure that the Camtrack Product(s) Software is normally available 24 hours a day and to mitigate where possible the adverse effects of the problems referred to in Clause 2, Camtrack shall not be liable in any way for loss(es) suffered as a result of any such problems or if for any other reason the Camtrack Product(s) Software and Service(s) or any part thereof is unavailable to the end user at any time or for any period

Clause 4

Camtrack shall have the right at any time and without any liability therefore: temporarily suspend access to the Camtrack Product(s) Software and Service(s) without notice for the purposes of maintaining or repairing the Website or any part thereof; and make changes to the functionality, presentation, features, modes of access and material content in relation to the Camtrack Software. Camtrackr will, in the ordinary course of events, give notice to the Partner of any planned access.

Camtrack Warranties
Camtrack guarantees to the customer that the products purchased will be free from defects for a
period of 12 months from delivery / installation unless otherwise stated on the order confirmation.
Should the products be defective within this period, Camtrack will repair or replace them within a
reasonable time using components or replacements that are new, or equivalent to new. In the case
of products rented from Camtrack this guarantee will continue for the duration of the product
rental. Any faults that a vehicle develops due to faulty equipment or installation are to be report within 24hr of the installation, Camtrack require to view all reported faults/problems/issues before any work is carried out by a third party unless authorisation has been given by Camtrack via email.

Camtrack will not be held liable for any repair work and associated costs including but not limited to labour / repair, parts or recovery
carried out to a vehicle/s before an inspection by Camtrack or a Camtrack representative has been completed and listed works agreed and authorised by Camtrack

Camtrack does not warrant that the products are fit for any particular purpose, nor that that the
services will be without disruption, nor that any reports, data or information provided as part of the
services will be free from errors, omissions, inaccuracies or nonconformities, and Camtrack shall
have no liability or obligation to the customer in this respect except as provided hereunder.
Camtrack makes no warranty for the security or integrity of any connection or transmission used
in the provision of the services.

Camtrack shall not be liable for and provides no warranty for any damage caused by the
customer or his representative or any unauthorised third party through incorrect installation, use,
modification or repair of the products, nor for any accidental or other damage to the products
caused by any party or external force

Camtrack Company Operating Times and bookings
Camtrack staff and office operate between 08.30 and 17.00 Monday to Friday and are closed on weekends
and public holiday, our out of hours answering service will be picked up as and when possible.

Any confirmed bookings cancelled within a 24 hrs period based on our operating hours are subject to a 50% cancellation fee.

Unconfirmed booking will be held for a maximum of 24hr, out of hours booking inc weekends
and between 17.00 and 08.30 are booked at the engineers discretion


Camtrack Delivery and Installation
All delivery times and dates are approximate, Camtrack or an appointed Camtrack Agent will endeavour to respect
times and dates offered.

Camtrack or a Camtrack appointed agent shall not be liable for any loss or damage resulting
from late delivery or from its failure to respect an appointment for installation.

If the customer delays the installation of any product beyond thirty days from the date of the first
product installation for that order, Camtrack shall be entitled to deliver the remaining products to
the customer’s delivery address and the order shall be deemed to be complete.
In the event that installation or removal of the equipment is carried out by the customer or a person
appointed by the customer, Camtrack shall not be liable for any loss or damage whatsoever,
arising directly or indirectly, as a result of any negligence.

Missed or cancelled appointments failed
by the customer due to vehicle/s not on site, vehicle/s unsafe to work on, customer not available,
incorrect paperwork completed or any reason outside the control of Camtrack will be deemed chargeable.
